Trustee Area Election System

Introduction

Aromas-San Juan Unified School District (ASJUSD) Governing Board members are currently elected by registered voters using an At-Large Election System where candidates campaigning for the ASJUSD Governing Board are permitted to reside anywhere in ASJUSD’s area of service. 

Only districts that elect by-trustee areas are immune from California Voting Rights Act ("CVRA") liability. The CVRA defines at-large elections as a methodology where candidates must simply reside in the District and are voted on by all of the District's voters. Ed. Code § 5030(a). The District currently uses an at-large system of electing its Board members. 

At the April 13, 2022, the School Board meeting directed the Superintendent or their designee, among other things, to initiate the process of changing the method of electing members of the Board, from the current at-large system whereby each member of the Board is elected by the registered voters of the entire District (Education Code section 5030(a)) to a method which provides that Board members residing in each trustee area will be elected by the registered voters of that particular trustee area (Education Code 5030(b)), in sufficient time for the new method of electing members of the Board to be in place for the November 2022 election.

If approved, registered voters in the school district boundaries will have the opportunity to vote for a candidate for ASJUSD’s Governing Board that lives in their trustee Area. Registered voters will not be able to vote for Governing Board candidates from trustee areas in which they do not reside.

Los miembros de la Junta de Gobierno del Distrito Escolar Unificado de Aromas-San Juan (ASJUSD) son actualmente elegidos por los votantes registrados utilizando un Sistema de Elección At-Large donde los candidatos que hacen campaña para la Junta de Gobierno de ASJUSD pueden residir en cualquier lugar en el área de servicio de ASJUSD.

Solo los distritos que eligen áreas por fideicomisario son inmunes a la responsabilidad de la Ley de Derechos Electorales de California ("CVRA"). La CVRA define las elecciones generales como una metodología en la que los candidatos simplemente deben residir en el Distrito y son votados por todos los votantes del Distrito. Código de Ed. § 5030(a). El Distrito actualmente utiliza un sistema general para elegir a los miembros de su Junta.

En el 13 de abril de 2022, la reunión de la Junta Escolar ordenó al Superintendente o a su designado, entre otras cosas, que iniciara el proceso de cambio del método de elección de los miembros de la Junta, del sistema actual en general por el cual cada miembro de la Junta es elegido por los votantes registrados de todo el Distrito (sección 5030 (a) del Código de Educación) a un método que establece que los miembros de la Junta que residen en cada área de fideicomisario serán elegidos por los votantes registrados de esa área de fideicomisarios en particular (Código de Educación 5030 (b)), con tiempo suficiente para que el nuevo método de elección de los miembros de la Junta esté en vigor para las elecciones de noviembre de 2022.

Si se aprueba, los votantes registrados en los límites del distrito escolar tendrán la oportunidad de votar por un candidato para la Junta de Gobierno de ASJUSD que viva en su área de fideicomisario. Los votantes registrados no podrán votar por los candidatos a la Junta de Gobierno de áreas de fideicomisarios en las que no residen.
